What is a CBD oil?
People who just start using CBD oil may wonder what it is and how it differs from THC and hemp oil – as it seems that these three are derived from the same plant – marijuana. This is partially true but, in order not to make any confusion in your heads, it is needed to describe thoroughly what are the fundamental differences among the three, what uses they have, what is the legal status of each, and how they are produced.
Let’s start with the definitions.
- THC stands for tetrahydrocannabinol. This substance is currently considered by the DEA (Drug Enforcement Administration of the US, a part of the US Justice Department) illegal. Mostly. It is widely used in various medical pieces of research but too few medicines are currently allowed officially based on CBD. This component mainly comes in two forms: as oil and as isolate. Oil has differing content of CBD, from some %s to around 40%, while the isolate is chemically purified CBD in the form of crystal powder, which has around 99,8% of CBD in it. CBD must not contain over 0.3% of THC in the dry mass in order to be legal under the Farm Bill of 2018, about which we are going to talk later.
- Hemp oil is the oil, which is actively used in food and beauty industries as the main component of edibles and cosmetic remedies actively applied by people. It is fatty oil, rich with Omega-3, 6, and 9, which is nearly the same as other fatty oils used by people and animals to eat. It does not contain naturally any CBD or THC in its content and does not cause any effect on the mental and physical state of the body like CBD or THC substances may cause – no ‘high’, no relaxation, nothing. It has a positive effect on the body in the form of the effect on the cells as foods have – similar to other oils or butter that people consume and digest (thanks to nutrients, micro and macro elements, fatty acids, elements of Mendeleev Table, and calories it contains).
The way of the manufacturing of all these:
- THC derives from the marijuana plant – the main species of plants of this type, and may contain around 5%-40% of THC in the THC oil or in a dry mass of any other form that it is manufactured. It is collected from leaves, stems, and flowers of the plant.
- CBD derives from stems (rarely – leaves) and flowers of Cannabis Sativa L., the species of a plant, which does not contain large amounts of THC naturally and/or which content is artificially lowered during the further treatment to receive the end product (no more than 0.3% of the dry mass). Some manufacturers purify the THC out completely, to make it zero content – to meet the requirements of the legislation of their states and to satisfy customers’ demand for the no-THC product (we’ll talk later about why it is important for many). It undergoes gentle, non-chemically aggressive purification, to receive a product with an as rich natural content of a product as possible, preserving by-products, which add flavor and smell to CBD oil or other product that is consumed by the end-user.
- Hemp oil is derived only by cold pressing from seeds of Cannabis Sativa L. (the same plant, which gives CBD oil) – not from any part of a plant, which is used to gain CBD oil. That is, if hemp oil contains any CBD oil or THC in it, there should be only small trace amounts of those, which happen to get into the product accidentally during contact with other parts of a plant during production.
What about the uses of the three?
- THC is used as a recreational drug in some states, known as ‘weed’, which is mostly illegal to produce, sell, and consume. DEA is authorized to wipe out the THC-containing substances of the American courtyard.
- CBD has a lot of applications: it is consumed as CBD oil to be added to foods and drinks by people themselves, it is a part of manufactured foods and drinks, it is sold as vapor, ointment, tincture, pills, sprays, soluble items, and a lot of other forms. It is consumed by people and pets, and sometimes – by animals.
- Hemp oil is widely used in cosmetology and food production and can be found in thousands of products, which people consume on a daily basis. Its production and turnover are not matters of control by any agency or authority – as none of the other edible oils is. Sometimes, it is funny to observe when opponents of CBD and marijuana consume hemp oil (derived from the marihuana-type of the plant) in their cornflakes or strawberry pie not even knowing it.

Is CBD Oil Legal?
There is no simple and short answer like ‘Yes’ or ‘No’. It depends on the territory of the world (there are over 200 countries and territories with own approach to the question). Within the US, it depends on the Federal law and local laws of states and cities. Also, different approaches apply to THC and CBD. Let’s figure out.
- The world.
On our planet, there are about 45 countries, which approved CBD to be used in medical and personal purposes. By saying ‘approved’, we mean a large variety of legal positions and definitions, which can be as such:
- criminalized but not enforced or rarely enforced, in exceptional cases
- criminalized but unenforced
- not enforced
- nobody cares and people widely earn money on production and sales of it
- legal but …
- okay for medical use
- okay for personal recreational use with or without conditions.
Nearly the same situation is with THC – despite its controversial effect on the body, which may be abused, around 50 countries of the world also consider it is okay to use (or okay with conditions). The list of conditions looks pretty much the same as the one above. The number of countries, which adopted THC for usage slightly overlaps with those who allowed CBD oil to be used. Altogether, we have approximately 90 countries of the world, which “allow” or do not enforce THC, CBD or THC + CBD.
But that doesn’t mean that you can produce, import or export, trade, make products of, and consume those substances in these countries just like that. Often, allowances or the policy of ‘looking through the fingers’ applies to the local population and it may be critically hard or impossible to make any import-export operations or to open manufactories to produce some products from THC/CBD on the territory of these countries if you’re a foreigner. In the majority of them, the level of corruption either eats you or the local enforcement/allowing bodies will make it illegal or impossible for you to make any business or consumption. For natural persons, it practically means that they should leave their THC and CBD back at home when they are going to any country abroad for a vacation or on a business trip – just in case, to avoid any adverse legal aspects of their staying abroad and crossing the border.
- The USA.
In the USA, it was a host of differing legislative bases for turnover of THC and CBD up to December 2018, when the Farming Bill of 2018 was adopted. According to it, any product with CBD is considered legal if:
- it has 0.3% or less THC in the dry mass of its content
- it is manufactured by a certified/approved manufacturer with a certified manufacturing process, which can demonstrate the sustainable quality
- the manufacturer should produce CBD oil within the requirements of the Farming bill and all applicable laws of the state and city where its business is registered.
That is, for instance, if the content is 0.2% but the manufacturer is not a licensed one, this product with CBD is still illegal. However, it is not always possible to crosscheck it, as farmers growing hemp, factories working with the raw material, and sales companies can be three different legal entities or even natural persons. If you have any doubts or it is important to you – ask for documents for every product that you consume, or every its separate stage, if the seller is not a company of a full cycle.
Some hemp species may have over 0.3% of THC in their content and they need additional purification in the process of obtaining the end product to make it under 0.3% according to federal demands. Also, it is important for some states and cities to reach some specific level of THC in the end product, as well as it is important for some people to have only the zero-CBD product.
Why do many people want to consume zero-THC products? It is because of drug tests in their workplaces. It’s not a secret that some employers test their workers on a periodic basis whether they are ‘clean’. Conventional drug tests react to THC even in such a small amount – 0.3%. So people tend not to consume anything THC-containing.
However, some people say that drug tests become more sophisticated and, with their advancement, they react to CBD oil as well. In some states, currently, it is legal without additional conditions. In most states, it is legal for medical use, with or without additional requirements to the purity of CBD oil towards the THC content in it. And only in three states, it is prohibited for any use: Idaho, South Dakota, and Nebraska. However, it is decriminalized in Nebraska, so, basically speaking, it is constructively illegal only in two US states. These have decided to adopt legislation, which prohibits it on the local level, so it’s unlikely you can consume, buy or produce CBD oil on their territory.
